Seule une procuration \u00ab\u202fperp\u00e9tuelle\u202f\u00bb ou \u00ab\u202fcontinuelle\u202f\u00bb reste en vigueur si la personne qui l\u2019a sign\u00e9e perd la capacit\u00e9 de prendre des d\u00e9cisions raisonnables concernant ses biens ou ses finances. Les repr\u00e9sentants l\u00e9gaux doivent s\u2019assurer qu\u2019ils disposent d\u2019une procuration \u00ab\u202fperp\u00e9tuelle\u202f\u00bb sign\u00e9e par le r\u00e9clamant lorsqu\u2019il \u00e9tait encore en mesure de prendre ses propres d\u00e9cisions financi\u00e8res et juridiques.\u202f\u202fSi vous ne disposez pas d\u2019une procuration\u202f\u00ab\u202fperp\u00e9tuelle\u202f\u00bb sign\u00e9e par la personne que vous repr\u00e9sentez, vous devrez fournir une autre preuve de repr\u00e9sentation. Cette exigence s\u2019applique parce qu\u2019une personne frapp\u00e9e d\u2019incapacit\u00e9 ne peut octroyer \u00e0 une autre personne l\u2019autorisation d\u2019agir en son nom. Dans de tels cas, le repr\u00e9sentant l\u00e9gal doit avoir une ordonnance de nomination \u00e0 soumettre comme preuve de repr\u00e9sentation.<\/p>\n<p><em>Remarque\u202f: Une procuration relative au soin de la personne, qui se rapporte aux d\u00e9cisions en mati\u00e8re de soins de sant\u00e9, ne sera pas accept\u00e9e comme pi\u00e8ce justificative d\u2019un repr\u00e9sentant l\u00e9gal.<\/em><\/p>\n<\/div><div class=\"fusion-text fusion-text-6\"><p><strong>Mandat de protection\u202f:<\/strong> semblable \u00e0 une procuration perp\u00e9tuelle, un mandat de protection est un document juridique qui autorise une personne \u00e0 nommer quelqu\u2019un d\u2019autre pour prendre des d\u00e9cisions en son nom dans l\u2019\u00e9ventualit\u00e9 o\u00f9 elle ne serait plus en mesure de le faire elle-m\u00eame. Seule une personne pouvant prendre des d\u00e9cisions financi\u00e8res et juridiques peut signer un mandat de protection. Le mandat reste en vigueur si la personne perd la capacit\u00e9 de prendre des d\u00e9cisions concernant ses biens ou ses finances. Les mandats de protections sont surtout utilis\u00e9s au Qu\u00e9bec et doivent \u00eatre notari\u00e9s ou approuv\u00e9s par la cour provinciale.\u202fComme une personne frapp\u00e9e d\u2019incapacit\u00e9 ne peut octroyer \u00e0 une autre personne l\u2019autorisation d\u2019agir en son nom, vous devez obtenir une ordonnance de nomination pour agir \u00e0 titre de repr\u00e9sentant l\u00e9gal, si vous n\u2019avez pas d\u00e9j\u00e0 un mandat de protection.<\/p>\n<\/div><div class=\"fusion-text fusion-text-7\"><p><strong>Ordonnance de nomination\u202f:<\/strong> une ordonnance de nomination est une ordonnance d\u2019une cour provinciale ou territoriale qui nomme quelqu\u2019un pour agir au nom d\u2019un particulier qui n\u2019a pas la capacit\u00e9 de g\u00e9rer ses affaires juridiques et financi\u00e8res ou de prendre des d\u00e9cisions raisonnables \u00e0 cet \u00e9gard. Elle peut aussi \u00eatre d\u00e9sign\u00e9e sous les noms de \u00ab\u202ftutelle\u202f\u00bb d\u2019une personne adulte, de \u00ab\u202fmandataire sp\u00e9cial\u202f\u00bb ou de \u00ab\u202fcuratelle\u202f\u00bb. Avant qu\u2019une ordonnance de nomination puisse \u00eatre \u00e9mise, un professionnel de la sant\u00e9 doit \u00e9valuer la personne frapp\u00e9e d\u2019incapacit\u00e9 afin de confirmer qu\u2019elle n\u2019a pas la capacit\u00e9 de g\u00e9rer ses affaires financi\u00e8res et juridiques.
